GENERAL TERMS OF USE OF THE WEBSITE: AVI-INTERNATIONAL.COM

 

The website as well as its content and services, hereinafter together referred to as the "Site," is published by:

AVI INTERNATIONAL – LES ASSURANCES DE PARIS,

Simplified Joint Stock Company (SAS) for insurance and reinsurance brokerage with a capital of 100,000 euros.
Registered with ORIAS under number 07 000 002 (www.orias.fr) and with the Trade and Companies Register of NANTERRE under number 323 234 575.

AVI provides individuals wishing to subscribe to a travel insurance policy (hereinafter referred to as the "Users") with a wide range of services accessible via the Site.
These general terms of use of the Site, hereinafter referred to as "Terms of Use," define the conditions applicable between the User and AVI as well as the rights and obligations of each party, regarding the use of the Site.
Any use of the Site implies consultation and acceptance of these Terms of Use.
These Terms of Use are subject to French law.

 

1. DEFINITIONS

The terms listed below used in these Terms of Use and beginning with a capital letter shall be understood as follows, whether used in the singular or plural, depending on the context of their use:

1.1. Insurer

Refers to the insurance company guaranteeing the coverage of the risk related to the travel insurance contracts offered on the Site.

The name of the insurance company is stated in the information and advisory documents presented on the Site.

1.2. Terms of Use (ToU)

Refers to these general terms of use intended to frame the terms of use of the Site by the User.

1.3. Content

Refers to all articles, photographs, illustrations, sheets, questionnaires, functionalities, and more broadly any element existing within the Site.

1.4. Personal Account

Refers to the personal space of the User which they can access after authentication.

1.5. Site

Refers to the website published by AVI and all the Services and Contents made available to Users.

1.6. Service

Refers to all the services offered and made available to Users within the Site as described in the ToU. The Services are provided via the Site either by AVI or by third-party companies under their exclusive responsibility, which the User acknowledges and accepts.

1.7. User

Refers to the individual, domiciled in metropolitan France, who has access to the Site.

 

2. USER'S USE OF THE SITE

2.1. Access Opening Procedure – User Account Creation

To create their account, the User is invited to provide the following information:

- Title
- Last Name
- First Name
- Postal Address (address, postal code, city, country)
- Email
- Password

Access to the Site is subject to prior identification of the User by entering an access code consisting of the email address and a password defined during the account creation; and its reset is possible through the secure "password reset" procedure.

2.2. Acceptance of the Terms of Use

Access to and use of the Site by the User imply the knowledge, unconditional acceptance, and compliance by the latter with these ToU.

The User's acceptance of the ToU occurs during their first connection to the Site.

Access to the ToU will be available from the link "Terms of Use" on the Site.

AVI reserves the right to modify the terms of these ToU at any time. In this case, the modified ToU will be brought to the attention of the User from the "Terms of Use" icon on the Site.

The User's connection to the Site will constitute acceptance of the modified ToU.

2.3. Access and Security

Access to the Site is personal, non-transferable, and temporary.

The username and password are strictly personal and must remain confidential; accordingly, the User agrees not to disclose them. Their use cannot be assigned or lent to a third party, for any reason whatsoever.

The User is responsible for their conservation and must take all necessary measures to ensure that their username and password are not known or used by third parties.

Furthermore, the User agrees not to disclose or appropriate those of another User.

2.4. Loss or Forgetfulness of Password

In case of loss or forgetfulness of the password, for whatever reason, AVI's liability cannot be incurred.

The User should click on the "forgot password" link present on the login block to enter their email address (the one provided during account creation) to receive an email inviting them to reset their password. For security reasons, the reset link is valid for 20 minutes.

This link allows the User to define a new password.

Fraudulent use of credentials to access the Services can cause harm and lead to prosecution.

2.5. Rules for Site Use

The User agrees to use the Site in a fair and honest manner, in accordance with its purpose and role, in compliance with the law and strict confidentiality.

If the accessed data does not belong to the User or if it contains an error, the User agrees to immediately inform AVI by email by contacting the administrator at the following address: dsi@avi-international.com

AVI cannot be held responsible for any harm caused by the User using information from this secure area for purposes other than those for which they are intended.

The User may request the deletion of their account at any time:

The User acknowledges and accepts that compliance with these ToU is a substantial condition for maintaining their access to the Site.
AVI may revoke access to the Site or certain features of the Site, without notice and without owing the User any compensation of any kind, in case of violation by the User of the provisions of these ToU making it impossible to maintain access to the Site, notwithstanding damages that may be claimed by AVI.

 

3. DESCRIPTION AND IMPLEMENTATION METHODS OF SERVICES ACCESSIBLE FROM THE SITE

It is specified that the Services on the Site are exclusively intended for Users.

- Presentation of travel insurance offers
- Creation of a personalized quote based on country of residence, age, destination, and duration of stay.
- Subscription to travel insurance online using secure payment
- Provision of a User personal space allowing to:
• update personal data,
• consult and validate quotes,
• consult and extend or renew contracts,
• make a refund request, send associated supporting documents, and track the progress of the request
- Dissemination of travel news

5. WARNING/TECHNICAL CONSTRAINTS

 

The User is informed about the constraints and limitations of the Internet network, particularly in terms of:
- Data transmission and possible data breaches;
- Continuity not guaranteed in accessing the Site or the various services offered by the Site;
- Technical constraints that are not under the control and responsibility of AVI.

In no event shall AVI be held responsible for these risks and their consequences, harmful, whatever their extent, for the User.
It is the responsibility of the User to take all appropriate measures to protect their own data, software, and hardware from contamination by viruses or other forms of attacks that may circulate through the Site.
The User cannot invoke any difficulty in accessing the Site to access information or services in violation of these Terms of Use.

Links may redirect to other applications, websites, or other social networks or services provided by third-party companies to AVI. AVI shall not be liable in the event that the content of such other applications, websites, or social networks or services violates the rights of third parties and any legal or regulatory provisions in force. These other applications, websites, or other social networks or services are provided under the sole responsibility of the companies that edit them, which the User expressly acknowledges and accepts.

The User is informed of the unreliability of the Internet network, especially in terms of relative security in data transmission, continuity not guaranteed in accessing the Site, performance not guaranteed in terms of volume and speed of data transmission, and virus propagation.

In this regard, AVI cannot be held responsible for damages resulting from viruses in any form, bug(s), or any program or application that may be incompatible with the infrastructure used by the User, nor for damages suffered by the User due to a breakdown, interruption, maintenance, technical problem, telephone network or telecommunications network outage, overload, negligence or fault of third parties or the User or an incompatibility of the configuration of the User's computer.

The User is responsible for implementing within their computer a solution and security measures to prevent the spread of viruses.

It is up to the User to verify the adequacy of the services and content offered via the Site to their needs. The User is solely responsible for any decision of any nature whatsoever, made based on information provided within the Content or Services offered via the Site.

 

6. RESPONSIBILITIES

6.1 User Responsibility

The User remains fully and personally responsible for the use of the Site under common law conditions.

It is the responsibility of the User:
• To keep their passwords and identifiers strictly confidential and not to disclose them to third parties, and, in general, to any third party regardless of their qualities and professional activities;
• To respect access management, in particular, not to use the passwords and identifier of another User, nor seek to know this information;
• To notify AVI of any technical malfunction observed and any anomaly discovered, such as intrusions;
• To use the Site in compliance with the legal and regulatory provisions in force as well as with the stipulations of these Terms of Use.

6.2 AVI Responsibility

AVI is bound by an obligation of means regarding the provision of the Site.

The Site is used under the sole responsibilities, controls, and direction of the User. AVI cannot in any case be held responsible for any direct or indirect damages, whatever they may be, resulting from the User's use of the Site and the Services for any reason and under any circumstances.
In this regard, the User undertakes to validate the adequacy of the Site and the Services to their needs, and to use the Site and the Services under normal conditions and in accordance with their purpose.
AVI is in no way responsible for the quality, timeliness, completeness, and accuracy of the data entered by the User, under their sole control, responsibilities, and direction.

IN NO EVENT DOES AVI VERIFY OR CONTROL THE COHERENCE OR RELEVANCE OF THE DATA ENTERED BY THE USER WITHIN THE SITE DURING THEIR USE OF THE SERVICES.

Consequently, the User is informed that AVI will not be responsible for damages resulting from:
• The User's use of the Content made available to them within the Site and through the Services, notably the interpretation made by the User and the consequences of their use;
• The disclosure by the User to third parties of their identifier and/or password;
• The User's use of another user's passwords and code;
• The User's registration of incomplete or incorrect information;

AVI will not be held responsible for any failure to perform or delay in performing the Services, caused by events beyond its control or force majeure as defined by the Civil Code.

The execution of these Terms of Use will be suspended for the duration of the force majeure event, and the deadlines for the performance of the Service will be extended accordingly. AVI will endeavor, to the extent possible, to end the force majeure event or to find a solution enabling it to perform its contractual obligations despite the force majeure event.

 

7. LIMITS OF LIABILITY CONCERNING THE SITE

The information provided on the Site is for general and informational purposes. AVI declines all responsibility for the use, interpretation that may be made of the information published on the Site and their possible consequences.
It is specified that AVI cannot be held liable for direct or indirect, material or immaterial damages resulting from the use of the Site or the inability to access it, or from a malfunction, interruption, virus, or a connection or system problem, actions of third parties, force majeure or fortuitous events, preventing access to the site or one of its features.

The connection equipment to the site used by the User remains their sole responsibility. They must take all appropriate measures to protect their equipment and their own data, especially in case of viral attacks via the Internet. They are also solely responsible for the sites and data they consult.
AVI cannot be held responsible for legal proceedings against the User:
- Due to the use of the site or any service accessible via the Internet;
- Due to non-compliance with these Terms of Use.
AVI is not responsible for damages caused to the User, third parties, and/or their equipment due to the connection or use of the Site.

 

8. INTELLECTUAL PROPERTY RIGHTS

8.1 Content and Services of the Site

All Content and Services accessible through the Site and the Services are protected by intellectual property rights, owned or claimed by AVI, its affiliated entities or used by AVI with the authorization of the holders of these rights.
These Services and Contents are exclusively intended for the personal information and use of the User, who benefits from a right of private, non-collective, and non-exclusive use.
Without the express prior authorization of AVI, all reproductions, representations, and uses by the User other than those mentioned above are prohibited, including in particular:
• Any adaptation, provision to the public at their request or not, distribution, rebroadcasting in any form whatsoever, networking, public communication, free or paid, of all or part of the works, performances, trademarks, and all elements protected or capable of protection by intellectual property law reproduced within the Site and the Services;
• Any link, access, modification, addition, deletion that affects the automated online publishing system and modifies the publication conditions or the editorial policy.

Any failure by the User to comply with these obligations would constitute an infringement punishable by articles L.335-2 and following of the Intellectual Property Code.

8.2 Databases

In accordance with the provisions relating to the protection of databases, AVI is the producer and owner of all or part of the databases composing the Site.

By accessing this Site, the User acknowledges that the data composing it is legally protected; it is notably prohibited for them to extract, reuse, store, reproduce, represent or preserve, directly or indirectly, on any medium, by any means and in any form whatsoever, all or a qualitatively or quantitatively substantial part of the content of the databases appearing within the Site to which they access, as well as to make repeated and systematic extraction or reuse of non-substantial parts qualitatively and quantitatively when these operations manifestly exceed normal conditions.

 

8.3 Trademarks and Distinctive Signs

Unless otherwise specified, all trademarks used within the Site are the property of AVI or its partners.
Without the express prior authorization of AVI and/or its partners, any use of this trademark as well as any other trademarks, figurative or not, visualized belonging to AVI or third parties exposes the User to legal proceedings.

10. HYPERTEXT LINKS

The establishment by the User of any hypertext links to all or part of the Site is strictly prohibited.
Any information accessible via a link to other sites is not under the control of AVI, which declines all responsibility for their content.

 

11. USER'S PERSONAL DATA

The data communicated to AVI in the context of the use of the Site are subject to processing in accordance with and in compliance with the law of January 6, 1978, as amended by the law of June 20, 2018, known as the "Data Protection Act", in accordance with the General Data Protection Regulation.
In this context, the data controller is AVI.

The Terms of Use are governed by French law. Any dispute as to their validity, interpretation, or execution shall be subject to the competent French courts.
